Marshall Fawley focuses his practice on regulatory issues in the alcohol beverage industry. He assists clients with obtaining or amending Federal Basic Permits and Brewer’s Notices from the Alcohol and Tobacco Tax and Trade Bureau (TTB), securing or amending state-level licenses and permits, and navigating the TTB’s Certificate of Label Approval (COLA) and Formula submission processes. He has significant experience with respect to flavors, tax issues and contracts involving various tiers of the alcohol beverage industry.
Marshall assists clients on a range of additional issues including analysis of Federal and State tied-house laws, advertising claims, brand acquisition due diligence, TTB Voluntary Disclosures, and analysis of state franchise laws. Marshall also regularly advises clients on Food and Drug Administration (FDA), Customs and Border Protection (CBP), and Internal Revenue Code (IRC) regulations as they relate to the alcohol beverage industry.
Marshall graduated from Pennsylvania State University with a JD in 2005. He graduated from George Mason University with an MA in 2003 and from the University of Virginia in 1998.
Marshall is admitted to the bars of Virginia and the District of Columbia. He is admitted to practice at the U.S. District Court for the District of Columbia, and the U.S. District Court for the Eastern District of Virginia.
